Key elements of our client's case
Mr Q was run down by the Defendants vehicle whilst crossing a road. Mr Q had pre-existing physical and mental health issues that meant that he was not able to work but was able to live independently. Post-accident his ability to care for himself was affected which meant that he moved to sheltered accommodation with support.
Both liability and the level of damages were in dispute.
Primary liability was admitted with offers being made on liability by the drivers insurer that we rejected.

We agreed rehabilitation for the claimant and jointly instructed a case manager who helped transition the client from hospital into new supported accommodation , his previous accommodation being unsuitability due to mobility issues post accident.
Reaching settlement
The parties agreed to exchange of medical evidence and a Joint Settlement meeting during lockdown that led to a settlement.
We agreed a discount of 33% for contributory negligence on Mr Q part which was a good compromise.
Damages were agreed at a considerable six figure sum after deduction for contributory negligence. A large part of this was for future care.
