Pedestrian accident claims experience

Cases involving pedestrians are amongst the most challenging, both emotionally and from a legal perspective – that’s why it’s essential to get a solicitor with the right experience on your side from the start.

Serious Law has been working on serious injury cases involving pedestrians for over 25 years, and we have a proud track record of winning significant compensation awards for our clients.

We regularly take on pedestrian injury cases abandoned by other law firms, when our expert understanding of the nuances of complex cases, together with our trusted, long-standing relationships with some of the UK’s leading forensic and accident reconstruction experts, allows us to achieve a successful outcome.

To give you an example of our work, in a recent child pedestrian case involving significant injuries, the Serious Law team successfully introduced evidence from a UK expert in road transport safety and an accident reconstruction specialist from a leading firm of consulting scientists and engineers.

By doing so, we were able to successfully challenge the data contained within the police technical report, examine the relationship between the speed of the car and the injuries suffered, and we achieved a result which was far beyond the initial expectations of our client’s family.

Frequently Asked Questions about Pedestrian Accident Claims

How long do I have to make a pedestrian accident claim?

In most cases, starting from the date of the accident, there is a three year time limit to make a personal injury claim, however there are some circumstances where this time limit may be extended. Seeking specialist advice early will enable your solicitor to collate all the necessary evidence for your claim whilst the accident/incident is fresh in the minds of the injured party and any witnesses.

What if I'm partly at fault for the accident?

If you've been involved in a pedestrian accident, you may be asking yourself; is it my fault? Am I partly to blame? In some cases, it may not be immediately clear who was at fault. It is important to discuss your situation with a specialist to find out the best way to move forward, as you may have a case. Our firm specialises in complex accident cases and difficult liability situations. We have helped many clients who questioned whether they had a case, we can do the same for you.

Can I make a pedestrian accident claim on behalf of a child?

A child, defined as a person aged under 18, is unable to bring a claim on their own. Children require a ‘Litigation Friend’ to instruct solicitors to carry out litigation on their behalf. It is commonly parents or a close friend who will claim on their behalf. Once you have appointed your solicitor, you will need to decide who is best placed for this role. Your solicitor will explain the duties of a Litigation Friend and help you decide who is best placed to do the job. Find out more about making serious injury claims for children.

What evidence will I need for my claim to be successful?

Evidence is an important part of a personal injury claim, therefore collating evidence of the injuries and losses you have suffered as a result of your accident will help your solicitor maximise your compensation. If possible, some items of evidence which will be helpful for your claim include; photos of the accident scene, names and contact details of any witnesses and receipts of any costs incurred following the incident. Our specialist serious injury solicitors will be able to advise you on what you will need to achieve a successful outcomeand will take a forensic approach to developing all aspects of your case.
